YOUR CHOICE. YOUR COMFORT. INFORMED CONSENT.

Wellness consent
& liability waiver.

Agreement version: October 6, 2026

Please read the entire agreement before signing. Ask Curtis any questions first. Print a copy to sign and bring, or review and sign a copy at the studio before your session. This webpage does not collect or store signatures. Merely viewing this page or booking an appointment is not acceptance of this liability release.

1. Parties & covered services

This agreement is between the undersigned adult participant (“I” or “me”) and Tha Alchemy Institute, LLC, doing business through Tha Alchemy Studios, and Curtis Ezell. “Released Parties” means that company, Curtis Ezell, and their employees or contractors acting within the scope of providing the agreed services.

It applies only to the session identified below and its agreed Reiki, sound healing, crystal bowl or tuning fork practices, chakra balancing, optional gentle breathwork, spiritual guidance, grounding, and integration conversations, together with ordinary movement within the studio during that visit. A new agreement is required if the services or material terms change.

2. Nature of the services & no guarantees

I understand these are complementary spiritual and wellness practices intended to provide space for relaxation, reflection, and personal awareness. Spiritual concepts are not medical diagnoses or scientifically established explanations of disease. No result, cure, emotional breakthrough, or health improvement is promised.

Curtis is a graduate counseling student and a Reiki and sound-healing practitioner. These services are not licensed psychotherapy, medical treatment, massage therapy, diagnosis, crisis care, or a professional medical or mental health relationship. Association membership does not confer a clinical license. I will not delay or discontinue prescribed treatment or medication because of a session, and I will seek appropriate licensed care for health concerns.

3. Voluntary participation & touch boundaries

I may ask questions, decline any practice, request lower sound levels, choose hands-off Reiki, change my position, take a break, or stop at any time. Consent to participation is ongoing and may be withdrawn. Light touch requires my express permission; there is no intimate touch, disrobing, or sexual service. Any direct placement of an instrument on my body requires separate permission at the time.

Breathwork, if offered, is optional and adapted to my comfort. I am not required to use rapid breathing or prolonged breath holds. I may continue breathing naturally throughout. No scents, smoke, or oils will be used without my consent.

4. Disclosures, suitability & foreseeable risks

I will discuss relevant limitations privately with Curtis before participating, including sound sensitivity, tinnitus or hearing concerns, susceptibility to dizziness or fainting, breathing difficulties, pregnancy, recent surgery, mobility needs, implanted devices, allergies, or circumstances that may make a technique unsuitable. I understand Curtis does not determine medical fitness or provide medical clearance; I will consult my licensed clinician when appropriate.

Possible experiences and risks include temporary discomfort, fatigue, dizziness, emotional distress or unexpected feelings; sensitivity or discomfort from sound or vibration; discomfort with touch or positioning; and slips, trips, falls, or personal-property loss during a studio visit. Not everyone experiences these effects. I will immediately speak up about discomfort and use care when standing or moving. I will not participate while impaired by alcohol or drugs or when unable to give informed consent.

5. Assumption of risk

I understand the disclosed risks and voluntarily choose to participate in the agreed services. To the extent permitted by law, I accept the inherent and reasonably foreseeable risks of participation. I retain the right to stop, decline, or modify a practice. This assumption does not excuse conduct or waive rights that cannot lawfully be released.

6. IMPORTANT: RELEASE OF ORDINARY NEGLIGENCE CLAIMS

TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I RELEASE THE RELEASED PARTIES FROM CLAIMS FOR PERSONAL INJURY, EMOTIONAL DISTRESS, DEATH, OR PROPERTY DAMAGE ARISING FROM MY VOLUNTARY PARTICIPATION IN THE AGREED SERVICES OR ORDINARY MOVEMENT WITHIN THE STUDIO DURING THE IDENTIFIED VISIT, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.

THIS RELEASE EXPRESSLY INCLUDES THE RELEASED PARTIES’ OWN ORDINARY NEGLIGENCE. IT DOES NOT RELEASE GROSS NEGLIGENCE, RECKLESSNESS, INTENTIONAL MISCONDUCT, SEXUAL MISCONDUCT, FRAUD, OR ANY LIABILITY OR STATUTORY RIGHT THAT CANNOT LAWFULLY BE WAIVED.

I understand that, where enforceable, this clause gives up my right to recover damages for the specified ordinary-negligence claims. It is not a guarantee that a court will enforce every provision.

7. Emergencies & personal information

If an urgent concern arises, the session may be stopped and emergency services contacted. This does not authorize medical treatment by the practitioner or require me to give up the right to accept or refuse treatment as permitted by law. I remain responsible for my own health-care decisions.

I will share only information reasonably needed for a comfortable session. This agreement does not authorize photography, recording, marketing, or publication of my story; those require separate consent. Signed agreements are provided directly to Curtis, not submitted through this webpage.

8. Fees & cancellation terms

I have reviewed the payment and cancellation policies supplied with this agreement. Advance payment is optional; full payment for rendered services is due at the end of the session. At least 24 hours’ cancellation or rescheduling notice avoids a fee. With less notice, the fee is 50% of the confirmed total; a missed appointment carries a 100% fee, subject to stated emergency exceptions and applicable law. This agreement is not authorization to automatically charge a saved card.

9. Scope, governing law & severability

This agreement is governed by Texas law to the extent applicable. If a provision is unenforceable, the remaining provisions remain effective where lawful; no invalid term will be expanded to create a release I did not clearly agree to. This agreement does not impose mandatory arbitration or waive non-waivable consumer protections. Changes require a written agreement by both parties.

I am at least 18 years old and have the capacity to consent. This adult agreement is not a guardian consent form and is not intended to waive a minor’s rights. I have had a reasonable opportunity to read it, ask questions, and decide freely whether to sign.

10. Acknowledgment & signature

By signing below, I acknowledge that I read and understand this agreement, including the prominent ordinary-negligence release, and voluntarily agree to its terms for the identified visit. I consent to the practices I choose during the session and understand I may withdraw consent at any time.
